    These Terms are provided in good faith and reflect our actual service practices. They are not a substitute for legal advice. A final attorney review is pending.

    1. Agreement to Terms

    By accessing or using the website at https://www.thetotalwash.com, or by engaging The Total Wash Co. LLC ("The Total Wash Co.") to perform any services, you agree to be bound by these Terms of Service. If you do not agree to all of these terms, please do not use the site or engage our services. These terms constitute a legally binding agreement between you and The Total Wash Co. LLC.

    2. Services & Service Area

    The Total Wash Co. provides professional exterior cleaning and maintenance services in the Madison, Wisconsin metropolitan area. Services include, but are not limited to:

    • Window cleaning (residential and commercial)
    • Pressure washing and power washing
    • House washing (soft wash and low-pressure)
    • Roof cleaning and moss/algae treatment
    • Gutter cleaning and gutter brightening
    • Concrete and driveway cleaning
    • Deck and fence restoration (cleaning, staining, sealing)
    • Commercial exterior cleaning and building maintenance
    • Snow removal and ice management
    • Salt and de-icer application

    All services are subject to availability, scheduling, and geographic service area restrictions. We primarily serve Madison, WI and surrounding Dane County communities within approximately 25 miles of downtown Madison. We do not provide services outside of Wisconsin.

    3. Quotes and Pricing

    Quotes and estimates provided through our website, by phone, email, or in person are based on the information you provide and are subject to the following conditions:

    • All quotes are valid for 30 days from the date of issue unless otherwise stated.
    • Final pricing may vary based on actual site conditions encountered upon arrival, including but not limited to excessive buildup, obstructions, accessibility issues, or undisclosed property characteristics.
    • The Total Wash Co. reserves the right to adjust pricing if the scope of work differs materially from the information provided at the time of the estimate.
    • Any price adjustments will be communicated to you before additional work begins, and you may decline the revised scope.
    • Promotional pricing, discounts, and bundled rates are non-transferable and may not be combined with other offers unless explicitly stated.

    4. Scheduling and Access

    To ensure safe and efficient service delivery, customers are responsible for:

    • Providing clear and unobstructed access to all work areas, including driveways, walkways, and gates.
    • Removing or securing personal items, outdoor furniture, vehicles, and decorations from service areas prior to the scheduled appointment.
    • Securing all pets indoors or in an area away from the work zone for the duration of service.
    • Notifying The Total Wash Co. in advance of any known hazards, including but not limited to underground sprinklers, loose siding, fragile landscaping, electric fences, security systems, or beehives/wasp nests.
    • Ensuring water access (exterior spigot/hose bib) is available and functional for pressure washing and exterior cleaning services.

    If our crew arrives and is unable to perform the scheduled service due to access issues or undisclosed conditions, a trip charge or full service charge may apply. See our Cancellation Policy for details.

    5. Payment Terms

    Payment is due upon completion of services unless otherwise agreed in writing (e.g., commercial contracts or recurring service agreements). The following payment terms apply:

    • We accept payment via credit card, debit card, digital wallet, and ACH via Stripe, and other methods as communicated at the time of service.
    • Invoices not paid within 30 days of the service date are subject to a late fee of 1.5% per month (18% annually) on the outstanding balance.
    • Returned payments or failed transactions may incur additional processing fees.
    • The Total Wash Co. reserves the right to suspend or decline future services for accounts with outstanding balances.
    • Commercial accounts may be eligible for Net 15 or Net 30 payment terms as specified in their Master Service Agreement.

    6. Cancellation and Rescheduling

    We ask that you provide at least 48 hours' notice for cancellations or rescheduling requests. Cancellations made within 48 hours of the scheduled service may be subject to a cancellation fee of up to 50% of the quoted service price. Same-day cancellations and no-shows may be charged the full quoted amount. Weather-related cancellations initiated by The Total Wash Co. will never incur a fee.

    7. Satisfaction Guarantee

    The Total Wash Co. stands behind every job. If you are not satisfied with our work:

    • Contact us within 48 hours of service completion to report any issues.
    • We will return to re-service the affected areas at no additional cost.
    • Our guarantee covers the quality of work performed and does not extend to pre-existing conditions, including but not limited to permanent staining, etching, oxidation, deteriorated surfaces, or damage caused by prior contractors.
    • Re-service requests must be for the same scope of work originally contracted.

    8. Liability & Liability Cap

    The Total Wash Co. is fully insured with $2,000,000 in general liability coverage per occurrence and maintains workers' compensation insurance for all employees. Despite our comprehensive insurance coverage:

    • Liability cap: Except where prohibited by law, our total liability for any claim arising from services rendered is limited to the amount paid by you for the specific service giving rise to the claim, or the applicable insurance coverage limit, whichever is less.
    • The Total Wash Co. is not liable for indirect, incidental, consequential, or punitive damages.
    • We are not responsible for damage to property that is in a pre-existing state of disrepair, including but not limited to rotted wood, deteriorated caulking, loose paint, cracked glass, aging roofing materials, or improperly installed fixtures.
    • Proof of insurance and certificates of insurance (COI) are available upon request for commercial clients.

    9. Property Damage Protocol

    While we take every precaution to protect your property during service, in the unlikely event of damage:

    • You must report any damage to The Total Wash Co. within 48 hours of service completion, including photographs if possible, at info@thetotalwash.com or (608) 360-5818.
    • The Total Wash Co. will inspect the reported damage and, if caused by our services, will arrange for repair or fair compensation.
    • We are not liable for damage resulting from pre-existing conditions, including rotted wood, loose paint or stucco, deteriorated mortar, aged caulking, improperly sealed windows, or other structural deficiencies that may be revealed or worsened during normal cleaning operations.
    • Claims for property damage exceeding our direct repair capability will be processed through our insurance carrier.
    • Failure to report damage within 48 hours may, at our reasonable discretion, be treated as a waiver of the claim.

    10. Indemnification

    You agree to indemnify, defend, and hold harmless The Total Wash Co. LLC, its owners, employees, contractors, and agents from and against any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable attorney's fees) arising out of or related to:

    • Your negligence or willful misconduct.
    • Inaccurate or incomplete property information provided to The Total Wash Co..
    • Failure to disclose known hazards, property defects, or access restrictions.
    • Your breach of any provision of these Terms of Service.
    • Claims by third parties arising from your use of our services or your property conditions.

    11. Recurring Service Plans

    The Total Wash Co. offers recurring service plans for ongoing maintenance. The following terms apply to all recurring service agreements:

    • Recurring plans automatically renew at the end of each service period unless cancelled with 30 days' written notice.
    • Pricing for renewed plans may be adjusted annually, subject to a maximum increase of 5% per year unless a greater increase is necessitated by significant changes in scope, materials costs, or regulatory requirements.
    • You may pause your recurring plan for up to 90 days without cancellation. Extended pauses may be treated as cancellation.
    • Cancellation of a recurring plan will take effect at the end of the current billing cycle. No refunds are issued for partially completed billing periods unless otherwise specified in your service agreement.
    • Recurring service customers receive priority scheduling and may be eligible for loyalty pricing.

    12. Snow & Ice Services

    Snow removal and ice management services are subject to the following additional terms:

    • Trigger thresholds: Service is initiated based on the snowfall accumulation threshold specified in your contract (typically 1-2 inches). Sub-threshold events may not trigger automatic service.
    • Response time: We aim to complete service within the timeframe specified in your agreement following the end of a qualifying snow event. Response times are measured from the end of snowfall, not the beginning.
    • Slip-and-fall liability: While we make every effort to clear snow and ice thoroughly, The Total Wash Co. cannot guarantee slip-free conditions at all times. Property owners retain responsibility for monitoring conditions between service visits.
    • Property damage: Minor turf, curb, or landscape damage is an inherent risk of snow plowing and removal operations. The Total Wash Co. is not liable for such incidental damage unless caused by gross negligence.
    • Salt and de-icer disclaimer: Salt and chemical de-icers may cause discoloration or damage to concrete, pavers, vegetation, and metal surfaces over time. By authorizing salt application, you acknowledge and accept this risk.
    • Seasonal contracts: Mid-season cancellation terms are outlined in our Cancellation Policy.

    13. SMS/Text Message Program

    Program name: The Total Wash Co. Service Notifications
    Description: When you submit a quote request, book a service, or engage The Total Wash Co., you may receive service-related text messages including quote confirmations, appointment reminders, crew arrival notifications, invoice links, and follow-up messages.
    Message frequency: Message frequency varies based on your service requests and account activity.
    Message and data rates may apply.
    Opt-out: Text STOP to cancel messages at any time. You will receive a single confirmation message. Opting out of SMS does not cancel scheduled services.

    Carriers: Carriers are not liable for delayed or undelivered messages.
    Privacy: Your phone number will not be shared with third parties for marketing purposes. See our Privacy Policy for details.

    14. Intellectual Property

    All content on the The Total Wash Co. website, including but not limited to text, graphics, logos, images, photographs, videos, icons, software, and the compilation thereof, is the exclusive property of The Total Wash Co. LLC and is protected by United States and international copyright, trademark, and intellectual property laws. You may not reproduce, distribute, modify, create derivative works from, publicly display, or otherwise exploit any content from this website without prior written consent from The Total Wash Co. LLC.

    15. Acceptable Website Use

    You agree to use this website only for lawful purposes and in accordance with these Terms. You agree not to:

    • Submit false, misleading, or fraudulent information through any form or tool on this website.
    • Attempt to gain unauthorized access to any portion of the website, server, or connected systems.
    • Use any automated tool, bot, scraper, or spider to access, monitor, or copy content from the website.
    • Interfere with or disrupt the website's operation, security, or other users' access.
    • Use the website to transmit viruses, malware, or other harmful code.
    • Impersonate any person or entity, or misrepresent your affiliation with any person or entity.

    16. Governing Law

    These Terms of Service and any dispute arising out of or related to them or the services provided by The Total Wash Co. shall be governed by and construed in accordance with the laws of the State of Wisconsin, without regard to its conflict of law provisions.

    17. Dispute Resolution — Binding Arbitration

    Please read this section carefully. It affects your legal rights, including your right to file a lawsuit in court.

    1. Informal resolution first. Before initiating arbitration, the parties shall attempt to resolve any dispute informally by contacting The Total Wash Co. at info@thetotalwash.com or (608) 360-5818. We will respond within 5 business days and negotiate in good faith for at least 30 days.
    2. Binding arbitration. If informal resolution fails, any remaining dispute, claim, or controversy arising out of or relating to these Terms or our services shall be resolved by binding arbitration administered by the American Arbitration Association ("AAA") under its Consumer Arbitration Rules (for consumer claims) or Commercial Arbitration Rules (for commercial claims). The arbitration shall be conducted by a single arbitrator in Madison, Wisconsin, or another mutually agreed location, or (at the customer's election for small claims) by written submissions. The arbitrator's decision shall be final and binding, and judgment on the award may be entered in any court of competent jurisdiction.
    3. Class-action waiver. To the fullest extent permitted by law, you and The Total Wash Co. waive the right to participate in any class, consolidated, or representative action. Disputes must be brought individually.
    4. Exceptions. Nothing in this section prevents either party from seeking injunctive or equitable relief in court to protect intellectual property rights, nor from bringing a claim in small-claims court where jurisdiction permits.
    5. Opt-out. You may opt out of this arbitration agreement within 30 days of first accepting these Terms by sending written notice to The Total Wash Co. LLC, Attn: Legal, 7610 Welton Dr, Madison, WI 53719-3024, or to info@thetotalwash.com with the subject line "Arbitration Opt-Out." Opting out will not affect any other provision of these Terms.
    6. Venue for non-arbitrable claims. Any claim that cannot be resolved in arbitration shall be brought exclusively in the state or federal courts located in Dane County, Wisconsin, and you consent to the personal jurisdiction of such courts.

    18. Disclaimer of Warranties

    THE WEBSITE AND ALL INFORMATION CONTAINED THEREIN ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, OR RESULTS. THE TOTAL WASH CO. LLC DOES NOT WARRANT THAT (A) THE WEBSITE WILL MEET YOUR REQUIREMENTS; (B) THE WEBSITE WILL BE UNINTERRUPTED, TIMELY, SECURE, OR ERROR-FREE; OR (C) THE RESULTS OBTAINED FROM USE OF THE WEBSITE WILL BE ACCURATE OR RELIABLE.

    With respect to services, The Total Wash Co. warrants only that services will be performed in a workmanlike manner consistent with industry standards. Results may vary depending on property condition, surface type, and degree of soiling.The Total Wash Co. makes no warranty that any specific level of cleanliness, appearance, or restoration will be achieved, and all satisfaction commitments are governed solely by Section 7 (Satisfaction Guarantee) of these Terms.

    19. Force Majeure

    The Total Wash Co. shall not be liable for any failure or delay in performing its obligations under these Terms to the extent such failure or delay is caused by circumstances beyond its reasonable control, including but not limited to: acts of God, severe weather events, natural disasters, fire, flood, ice storms, extreme temperatures, labor disputes, supply chain disruptions, pandemic or public health emergencies, government orders or restrictions, civil disturbances, or failures of third-party utilities or infrastructure.

    In the event of a force majeure condition affecting scheduled services, The Total Wash Co. will notify you as promptly as reasonably possible and will work in good faith to reschedule the affected services at no additional cost. Any deposits or prepayments for unperformed services will be credited to rescheduled services or refunded upon your request.

    20. Photography & Marketing Use

    During the course of service delivery, The Total Wash Co. may capture photographs or video of your property for the following limited purposes:

    • Quality documentation — before/after photos to document the scope and results of work performed, included in job reports or invoices.
    • Insurance and liability purposes — documenting the condition of the property prior to service commencement.
    • Training purposes — internal crew training and quality review. Your property address is not disclosed in training materials.
    • Marketing use — with your explicit prior consent only. Photos used for marketing (website, social media, advertising) will only be used if you have opted in via our service agreement, a post-service consent request, or written confirmation. You may withdraw marketing consent at any time by contacting us at info@thetotalwash.com. Identifying property addresses are never included in public marketing materials without separate written consent.

    You may opt out of all non-documentation photography at any time by notifying The Total Wash Co. in writing before or at the time of service. Opt-out of photography does not affect the delivery or quality of any service.

    22. Severability

    If any provision of these Terms of Service is found to be invalid, illegal, or unenforceable by a court of competent jurisdiction, such invalidity shall not affect the validity or enforceability of the remaining provisions, which shall continue in full force and effect. The invalid or unenforceable provision shall be modified to the minimum extent necessary to make it valid and enforceable while preserving its original intent.

    23. Changes to Terms

    The Total Wash Co. reserves the right to update, modify, or replace these Terms of Service at any time at our sole discretion. Changes will be effective immediately upon posting to this page with an updated "Last updated" date. Your continued use of our website or services after any changes constitutes your acceptance of the revised terms. For material changes that significantly affect your rights or obligations, we will make reasonable efforts to provide advance notice via email or website notification.
